Funding Agreements (Enforceability) Bill
This bill was a quick fix to a Supreme Court ruling that threw a wrench into the works for litigation funders. The court decided that most funding deals were unenforceable because they were classified as damages-based agreements (DBAs), which are a no-no. Justice Secretary Alex Chalk KC wanted to rewind the clock and undo this decision. The bill zipped through the House of Lords, but some peers were worried about its retroactive nature and an upcoming review of litigation funding. It was all set for more debate until Sunak’s surprise election announcement threw it into uncertainty.
