Innsworth v Mastercard: Who Really Wins a Class Action?

What is this case about?
The claim, brought by Walter Merricks on behalf of around 46 million UK consumers, alleged that Mastercard’s unlawful interchange fees were passed on to shoppers through higher prices. Originally valued at up to £14 billion, the case became the UK’s largest-ever consumer class action before settling in 2024 for £200 million.
Now, litigation funder Innsworth is challenging how the Competition Appeal Tribunal approved the distribution of the £200 million settlement reached with Walter Merricks. The funder argues the CAT misunderstood key authorities and ignored the agreed funding terms when it capped Innsworth’s return at around £68 million.
Innsworth is not challenging the size of the settlement itself. The argument is about whether courts can retrospectively reshape commercial funding arrangements once a case is over.
